Terms of sale

01Scope

These terms apply to all sales of Orphela products by Les Produits Lominy Inc. to consumers and businesses, whether the order is placed by form, email or phone. Wholesale sales may also be covered by a separate written agreement, which prevails in case of conflict.

02Ordering process

Sending an order request does not create a contract. Once we receive it, we send you a written confirmation stating: the products and quantities, the price of each item, applicable taxes, delivery fees, the total in Canadian dollars, accepted payment methods and the expected delivery date or timeframe.

The contract is formed when you accept that confirmation. We then send you a copy of the contract, as required by the Quebec Consumer Protection Act for distance contracts.

03Prices and taxes

Prices are in Canadian dollars. GST and QST, or HST depending on the delivery province, are added as required by law where applicable. The price confirmed in writing is the price you are charged; we cannot charge more than the price stated in the confirmation.

04Payment

Accepted payment methods are listed in your confirmation (for example Interac e-Transfer or a secure payment link). We never ask for card details by email or phone. Orders are prepared once payment is received, unless otherwise agreed with a wholesale customer.

05Availability

Products are offered while supplies last. If a product becomes unavailable after your confirmation, we will tell you promptly and offer a revised timeline or a full refund of any amount paid for that product.

06Delivery

Delivery terms, timelines and fees are described in our Shipping and returns policy and confirmed for each order.

07Consumer cancellation rights

Under the Quebec Consumer Protection Act, you may in particular cancel a distance contract within 7 days after receiving your copy of the contract if we did not provide the required information, or if delivery is not made within 30 days of the agreed date (or of the contract date if no date was set). We then refund all amounts paid within 15 days of the cancellation.

These rights are in addition to our shipping and returns policy and cannot be limited by these terms.

08Warranty and conformity

Our products are sold with the legal warranty of quality provided by law. If a product is damaged, defective or not as ordered, see our Shipping and returns policy: we will replace or refund it.

09Product use

Orphela paste is extra hot. Read our food safety and allergens guidance and the label before eating. It is meant to be used in small amounts, as a condiment.

10Governing law

These terms are governed by the laws of Quebec and Canada. Nothing in these terms limits the rights granted to you by the Quebec Consumer Protection Act.
